Terms of Service

These Terms of Service ("Terms") govern your use of the BLDGDeck website, application, and related services (collectively, the "Service"). "BLDGDeck," "we," "us," and "our" refer to the operator of the Service. By creating an account or using the Service, you agree to these Terms.
1. What BLDGDeck is — and is not
BLDGDeck is an informational AI workspace that organizes documents for a property project and generates plain-language explanations, comparisons, and prioritized next steps. BLDGDeck is not a law firm, engineering firm, inspection firm, real-estate brokerage, mortgage lender, insurance broker or agency, tax preparer, appraiser, contractor, or any other licensed professional. Nothing produced by BLDGDeck constitutes legal, engineering, inspection, lending, insurance, tax, appraisal, brokerage, contracting, or other licensed professional advice.
2. Eligibility & accounts
You must be at least 18 years old and able to form a binding contract to use the Service. You are responsible for all activity that occurs under your account and for keeping your credentials secure. You must provide accurate information and keep it up to date.
3. Documents you upload
You may upload documents to a Project only if you have the right and authority to do so — either because you own them or because you have permission from the owner. You must not upload materials that infringe intellectual property, violate confidentiality obligations, or contain content prohibited by our Acceptable Use Policy. You retain ownership of the documents you upload. You grant BLDGDeck a limited license to store, process, and display those documents solely to provide the Service to you.
4. AI outputs
The Service uses third-party large-language-model providers to generate AI outputs. AI outputs may contain errors, omissions, misinterpretations, or fabricated information. You are responsible for reviewing every AI output against the source documents and confirming it with a qualified professional where appropriate. Do not rely on any AI output for a legally or financially significant decision without independent review.
5. Plans, trials, and billing
The Service is offered through both one-time purchases and recurring subscriptions. Current pricing is available on the Pricing page. By purchasing a plan you authorize BLDGDeck's payment processor (Stripe) to charge your payment method for the applicable fees.
- Property Project (one-time, $59): unlocks a single Project with 90 days of full read/write access. After 90 days the Project becomes read-only; existing content remains readable. You may extend for another 90 days for $59.
- Subscriptions: Individual Investor ($69/mo, 7-day free trial), Professional Solo ($149/mo, 14-day free trial), and Professional Team ($499/mo, 30-day free trial). Trials are one per person. A payment method is required at checkout; you are not charged during the trial and may cancel before the trial ends to pay nothing.
- Renewals: Subscriptions renew automatically at the end of each billing period until cancelled.
- Cancellation: You may cancel from the customer billing portal at any time. Access continues to the end of the current paid period.
- Failed payments: If a renewal payment fails, Stripe automatically retries. Access continues during a grace period of up to 7 days. If payment is not recovered within the grace window, access becomes read-only until billing is resolved.
6. Upgrades, downgrades, and data preservation
Upgrades and downgrades between plans use Stripe proration and preserve your Projects, documents, workflow history, AI analyses, citations, findings, notes, and usage history. Upgrading a Property Project to a subscription does not create a duplicate Project.
7. Refunds
Refund terms are described in our Refund & Cancellation Policy. In summary: recurring subscription fees are non-refundable except where required by law; one-time Property Project purchases may be eligible for a full refund within a limited window if the Project has not been used substantively.
8. Acceptable use
You agree to comply with our Acceptable Use Policy. We may suspend or terminate accounts that violate it.
9. Availability & modifications
We aim to keep the Service available but do not guarantee uninterrupted access. Features may be added, changed, or removed. Material changes to paid plans will be communicated in advance.
10. Disclaimer of warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.
11. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, BLDGDECK'S AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID TO BLDGDECK IN THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM. BLDGDECK WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES.
12. Indemnity
You agree to indemnify and hold BLDGDeck harmless from any claim arising out of your use of the Service or your violation of these Terms, including any claim relating to documents you upload.
13. Termination
You may terminate your account at any time. We may terminate or suspend your account for material breach of these Terms.
14. Governing law
These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws principles. The exclusive forum for disputes will be the state or federal courts located in New York County, New York, subject to any mandatory consumer protections in your jurisdiction.
15. Changes to these Terms
We may update these Terms from time to time. Material changes will be announced in advance. Continued use of the Service after changes take effect constitutes acceptance.
